How this service works
Like kind property is the foundational requirement of a 1031 exchange, and it is also one of the most misunderstood terms in the tax code. Since the Tax Cuts and Jobs Act took effect for exchanges completed after December thirty first, two thousand seventeen, Section 1031 applies only to real property. Personal property exchanges, such as trading equipment, vehicles, or franchise licenses, no longer qualify, regardless of how similar the assets are.
For real property, the definition of like kind is broad. Nearly any real property held for productive use in a trade or business, or held for investment, can be exchanged for any other real property held for the same purpose. An investor can exchange raw land for a retail strip center, an apartment building for an industrial warehouse, or a single tenant net lease property for a multifamily complex. The properties do not need to be similar in type, size, or use. What matters is that both the relinquished property and the replacement property are real property held for business or investment purposes.
Certain property is excluded regardless of type. A primary residence does not qualify, because it is held for personal use rather than business or investment. Property held primarily for sale, such as a builder's inventory or a fix and flip project, also does not qualify, because it is treated as dealer property rather than investment property. Foreign real property is excluded as well, since real property located outside the United States is not considered like kind to real property located within the United States.
